General Terms and Conditions (GTC) for the Use of  the Moodle Learning Platform at University of Cologne Business School (UCBS)

1. Scope of Application

These General Terms and Conditions apply to enrolled students of the Executive MBA programme as well as to external participants who take part in individual educational programmes offered by UCBS.

2. Access to the Moodle Learning Platform

Participants receive individual login credentials for the Moodle learning platform for the duration of their studies or registered programme. Access is personal and may only be used by the registered individual. Sharing login data with third parties is strictly prohibited.

Users are obliged to keep their login credentials confidential and to inform UCBS immediately if there are any indications of unauthorized access by third parties.

Access to the platform ends for EMBA students upon completion of their studies, and for external participants no later than four weeks after the end of the respective programme, unless otherwise agreed.

3. Purpose of Use

The Moodle learning platform supports the digital delivery of study and training programmes at UCBS. It allows access to educational materials, participation in online learning activities, and communication with instructors and fellow participants. Commercial use, advertising, or distribution of content to third parties is not permitted.

4. Content and Copyright Protection

All content provided on the platform - such as texts, presentations, videos, and documents - is protected by copyright and may only be used within the scope of the respective study or training programme. Any further use, reproduction, or distribution, even in part, is not permitted without prior written consent from UCBS or the respective rights holders.

5. Obligations of Participants

Users agree to engage respectfully, professionally, and constructively on the platform. Any misuse of the platform’s technical infrastructure is prohibited. In particular, uploading or sharing content that violates applicable law or third-party rights, or that damages the reputation of UCBS, is not allowed.

Participants are solely responsible for any content they post on the platform (e.g. forum posts, uploads, or comments). They may not publish content that violates laws, third-party rights, or commonly accepted standards.

UCBS reserves the right to temporarily or permanently block access in the event of violations. In serious cases, this may result in exclusion from the study or training programme.

6. Technical Availability and Maintenance

UCBS aims to ensure uninterrupted access to the learning platform. However, temporary outages due to maintenance, force majeure, or unforeseen technical issues cannot be ruled out. There is no entitlement to continuous availability. UCBS is only liable for damages caused by unavailability in cases of intent or gross negligence.

7. Certificates of Participation for External Participants

External participants who successfully complete a programme will receive a certificate of participation, provided they meet the necessary requirements - such as attendance or participation. The decision to issue a certificate lies solely with UCBS.

8. Data Protection

The processing of personal data is carried out in accordance with applicable data protection regulations, particularly the General Data Protection Regulation (GDPR). The personal data provided in the registration form - such as name, email address, and phone number - is required for the execution of the resulting contractual relationship and is collected on the basis of Art. 6 para. 1(b) GDPR.

This data is used solely for internal organizational purposes, communication regarding the registered event, and to send information about UCBS programs. It is stored on UCBS servers and is only accessible to authorized personnel. Personal data will not be shared with third parties. Further data collection will only take place with explicit consent.

The receipt of information about UCBS programmes may be revoked at any time with future effect.

In certain cases - such as group emails or collaboration features on Moodle - personal data (e.g. email addresses) may be visible to other participants. This occurs only when necessary for organizational purposes.

9. Use of Photo and Video Material

By registering and signing the registration form, participants expressly agree that UCBS and authorized third parties may use photos and video recordings taken during seminars, lectures, or other events for editorial, commercial, and promotional purposes.

This includes use in printed materials such as flyers and brochures, publication in digital media including social networks (e.g. LinkedIn, Xing, Facebook), and presentation at trade fairs, university events, or on UCBS websites. The rights granted to use this material are unlimited in time and geography.

Participants may revoke their consent to the use of such material at any time with future effect by submitting written notice to the UCBS.

10. Recording of Online Events

In the case of online seminars or other digital events by UCBS, these may be recorded for documentation or quality assurance purposes. Participants will be informed in advance about planned recordings. The recordings are accessible only to authorized participants of the respective event. Redistribution or publication by participants is not permitted.

11. Changes to the GTC

UCBS reserves the right to amend these General Terms and Conditions with future effect, if necessary for organizational, legal, or substantive reasons. Users will be notified in advance of significant changes. If no objection is raised within 14 days of notification, the amended version is deemed accepted.

12. Final Provisions

These GTC are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction for all disputes arising in connection with these GTC, to the extent legally permissible, is Cologne.

If any provision of these GTC is or becomes invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a valid provision that most closely reflects the original intent.
